Notice

The information on this site pertains only to the Municipal Court for the City of Walsenburg. All court proceedings are governed by city ordinances, court rules and state statutes. Court employees are not allowed to give legal advice, but will be happy to answer any procedural questions.

Advisement

The Walsenburg Municipal Court informs you, the defendant, of the following rights:

  1. Right to continuance for good cause and bail;
  2. Right to make no statement, and that any statement made can and will be used against you;
  3. Right to counsel. You must notify this court immediately if you choose to seek counsel, and a continuance will be granted; you may request counsel if you cannot afford one for offenses whose sentence may include jail.
  4. Right to testify or not to testify on your own behalf;
  5. Right to a jury trial; if you wish to invoke your right to a jury trial, you must request same, in writing, within twenty-one (21) days of plea; you will have a jury of three to six members, and you shall tender a $25 fee to the Court Clerk.
  6. Right to Appeal;
  7. If you are convicted of a crime, you will face certain penalties imposed by the court such as jail time, probation, fines, etc.  Your conviction may also bring collateral consequences other than penalties imposed by the court.  For example, you may not be eligible for certain public benefits or housing, or impact your immigration status.   
  8. The Court shall not accept a plea of guilty or nolo contendere without first determining whether the you are serving in the United States Armed Forces or are a veteran. If you are a veteran you may be entitle to receive services.  
  9. The Court will not be bound by representations about penalties unless included in a formal plea agreement accepted by the Court. A plea must be voluntary & not result of undue influence or coercion. Any plea you make must have a basis in fact or a waiver of that basis.
  10. You have the right to have process issued by the court, without expense to the you, to compel the attendance of witnesses in your behalf.

The maximum sentence this Court may impose is a 90 day jail sentence, a $300 fine, or both. Not all ordinance violations include the possibility of a jail sentence.

Authority and Jurisdiction:

The Walsenburg Municipal Court has jurisdiction over violations of City Ordinances. (CRS 13-10-104)This court handles Traffic, Parking, Animal, No Proof of Insurance, and Misdemeanor criminal offenses that have occurred within the Walsenburg city limits. The Municipal Court does not handle DUI or felony cases. These tickets are written into the County and District combined court.

Municipal Judge:

The Municipal Court is presided over by a Municipal Judge appointed by City Council for a two-year term and may be reappointed for a subsequent terms. A municipal judge may be removed during his term of office only for cause.

Juveniles:

A parent or legal guardian must appear with juveniles on all cases.

How do I act in court?

Court etiquette includes dressing appropriately for court. Do not eat or drink in the courtroom. There are no cell phones or pagers allowed in the courtroom. There may be other cases called before your case. Please be quiet and patient. If you are wearing a hat, please remove it in the courtroom. When the judge calls your name, step up to the podium. If you do not understand, be sure to tell the judge that you do not understand.
